72 4 法理学、宪法学、民法原理 3或4 课程简介: 本课程教学目的是使学生掌握经济法的基本概念和原理,了解经济法的学说和制度的基本体系、内容及其最新发展,并能初步掌握运用所学知识分析相应的法律实际问题.

课程内容包括经济法总论(经济法的概念、地位、体系和渊源、经济法法律关系、经济法的制定和实施);

经济组织法(公司法律制度、全民所有制工业企业法律制度、合伙企业法律制度、个人独资企业法律制度、外商投资企业法律制度);

市场管理法(反垄断法律制度、反不正当竞争法律制度、消费者权益保护法律制度、产品质量法律制度、证券法律制度、房地产管理法律制度);

宏观调控法(计划和统计法律制度、固定资产投资法律制度、国有资产管理法律制度、财政法律制度、税收法律制度、银行法律制度、价格法律制度、会计和审计法律制度、对外贸易法律制度);

社会保障法(社会保障法律制度概述、社会保险法律制度、社会救济法律制度)等部分. 本课程安排两次课堂专题讨论,安排两次课堂案例讨论,以帮助学生对课程的基本知识和前沿问题有比较全面、深刻的掌握. Brief Introduction of the course The purposes of this course's teaching are the following: making the students grasp the basic concepts and principles of economic law;

making the students understand basic systems, contents and the latest development of economic law's theories and institutions;

making the students have the abilities of using the knowledge learned to analyze the factual law issues. The contents of this course includes the following: the general introduction of the economic law (the concept, status, systems and sources of economic law;

the legal relations of economic law;

the enactment and enforcement of economic law);

the economic organization law ( corporations law, the people's-owned industrial enterprises law, partnership law, individuals investment enterprises law, foreign investment enterprises law);

the law regarding the management of the market ( anti-monopoly law, anti-unfair competition law, the consumers' interests protection law, product liability law, securities law, real property law);

macro-regulation law (the planning and statistic law, fixed assets investment law, the state-owned assets regulation law, finance law, tax law, bank law, price law, accounting and auditing law, foreign trade law),social securities law ( the general introduction to the social securities law, social insurance law and social relief law). This course arranges two special discussions in class, two cases studies in class.
