s Republic of China /64 中华人民共和国农业部公报 重要文件 中办国办印发 《关于引导农村土地经营权有序流转 发展农业适度规模经营的意见》 近日, 中共中央办公厅、 国务院办公厅印发了 《关于引导农村土地经营权有序流转发展农业适度规模 经营的意见》 , 并发出通知, 要求各地区各部门结合实际认真贯彻执行. 《关于引导农村土地经营权有序流转发展农业适度规模经营的意见》全文如下. 伴随我国工业化、 信息化、 城镇化和农业现代化进程, 农村劳动力大量转移, 农业物质技术装备水平 不断提高, 农户承包土地的经营权流转明显加快, 发展适度规模经营已成为必然趋势. 实践证明, 土地流 转和适度规模经营是发展现代农业的必由之路, 有利于优化土地资源配置和提高劳动生产率, 有利于保 障粮食安全和主要农产品供给, 有利于促进农业技术推广应用和农业增效、 农民增收, 应从我国人多地 少、 农村情况千差万别的实际出发, 积极稳妥地推进. 为引导农村土地 (指承包耕地)经营权有序流转、 发 展农业适度规模经营, 现提出如下意见.

一、 总体要求

(一)指导思想. 全面理解、 准确把握中央关于全面深化农村改革的精神, 按照加快构建以农户家庭 经营为基础、 合作与联合为纽带、 社会化服务为支撑的立体式复合型现代农业经营体系和走生产技术先 进、 经营规模适度、 市场竞争力强、 生态环境可持续的中国特色新型农业现代化道路的要求, 以保障国家 粮食安全、 促进农业增效和农民增收为目标, 坚持农村土地集体所有, 实现所有权、 承包权、 经营权三权 分置, 引导土地经营权有序流转, 坚持家庭经营的基础性地位, 积极培育新型经营主体, 发展多种形式的 适度规模经营, 巩固和完善农村基本经营制度. 改革的方向要明, 步子要稳, 既要加大政策扶持力度, 加 强典型示范引导, 鼓励创新农业经营体制机制, 又要因地制宜、 循序渐进, 不能搞大跃进, 不能搞强迫命 令, 不能搞行政瞎指挥, 使农业适度规模经营发展与城镇化进程和农村劳动力转移规模相适应, 与农业 科技进步和生产手段改进程度相适应, 与农业社会化服务水平提高相适应, 让农民成为土地流转和规模 经营的积极参与者和真正受益者, 避免走弯路.

(二)基本原则 ――坚持农村土地集体所有权, 稳定农户承包权, 放活土地经营权, 以家庭承包经营为基础, 推进家 庭经营、 集体经营、 合作经营、 企业经营等多种经营方式共同发展. ――坚持以改革为动力, 充分发挥农民首创精神, 鼓励创新, 支持基层先行先试, 靠改革破解发展难 题. ――坚持依法、 自愿、 有偿, 以农民为主体, 政府扶持引导, 市场配置资源, 土地经营权流转不得违背 中华人民共和国农业部公报 重要文件 承包农户意愿、 不得损害农民权益、 不得改变土地用途、 不得破坏农业综合生产能力和农业生态环境. ――坚持经营规模适度, 既要注重提升土地经营规模, 又要防止土地过度集中, 兼顾效率与公平, 不 断提高劳动生产率、 土地产出率和资源利用率, 确保农地农用, 重点支持发展粮食规模化生产.

二、 稳定完善农村土地承包关系

(三)健全土地承包经营权登记制度. 建立健全承包合同取得权利、 登记记载权利、 证书证明权利的 土地承包经营权登记制度, 是稳定农村土地承包关系、 促进土地经营权流转、 发展适度规模经营的重要 基础性工作. 完善承包合同, 健全登记簿, 颁发权属证书, 强化土地承包经营权物权保护, 为开展土地流 转、 调处土地纠纷、 完善补贴政策、 进行征地补偿和抵押担保提供重要依据. 建立健全土地承包经营权 信息应用平台, 方便群众查询, 利于服务管理. 土地承包经营权........
