3 版权向左研究 摘要 随着网络技术的发展和普及, 越来越多的版权人使用互联网这一媒介来发表 自己的作品.在这些作品中,很大一部分作品所采用的版权许可协议都是具有 Copyleft 性质的――一种崇尚自由, 但是却极具传染性的许可协议. 自从 Copyleft 第一次被 Richard Stallman 提出发展到今天,已经获得了广泛的应用.这种基于 共享和自由而存在的理念被人们用协议的形式规定下来, 在我国也受到越来越多 的重视. 中文维基百科、 众多个人博客还有各种自由软件构成了 Copyleft 的主要 群体. 虽然, 采用这种许可协议的作品大都可以免费获得,但是侵权现象却仍然屡 屡发生, 这正是由于 Copyleft 的传染特性所导致的――将作品置于著作权法律的 保护下, 然后在特定条件下授予他人一定的版权许可,但是一旦该他人违反特定 条件,所有版权许可均失去效力,作品再次置于严格的版权法律保护下.本文将 从Copyleft 的历史起源出发,在第一部分探讨 Copyleft 的定义、特征和 Copyleft 的翻译;

第二部分则结合两种常见的 Copyleft 许可协议――GNU 通用公共许可 协议(The Gnu General Public License)和知识共享许可协议(Creative Common License)――来研究 Copyleft 在现实生活中的运用,最后一部分则将会论述 Copyleft 对于我国建立完善的,适合我国国情的版权法律制度发展所带来的启 示. 关键词:Copyleft, GPL,知识共享 上海大学毕业设计(论文)

4 ABSTRACT With the development and popularity of network technology, more and more people publish their work on the internet. Among those works, Copyleft licenses are often used, which stands for freedom, but also has serious infectious. Copyleft was first put forward by Richard Stallman, and till now it had been widely spread. People use contact to stipulate the right of freedom and share brought by Copyleft. Lately people in our country pay more and more attention to it. Wikipedia China, lots of personal blogs and free software are released under different Copyleft licenses. Though others may get Copyleft works for free, torts still happen a lot. This is because of its serious infectious. It claims a work is protected by copyright law, and then it gives other people some right to redistribute or modify the work under certain circumstance. If someone redistributes or modifies that work but don'

t meet the circumstance, then the right that Copyleft license gives loss. This article talks about the history of Copyleft at the very beginning. In the first section, it explains what Copyleft and its characteristics are and how to translate Copyleft into Chinese. After that, it shows how Copyleft are practiced by the GNU General Public License and the Creative Common License. In the last part, I try to figure out how we can make our own copyright legal system better by learning from the key ideas of Copyleft. Keywords: Copy left, GPL, Creative Common 上海大学毕业设计(论文)
